New Delhi | Jagran News Desk: In the political hustle for power in Maharashtra, BJP's Devendra Fadnavis, who sworn-in as the Chief Minister on Saturday along with NCP's Ajit Pawar, who took oath as the Deputy Chief Minister, resigned from their respective posts paving way for the Shiv Sena-NCP-Congress 'Maharashtra Vikas Aghadi' to form the government in the state. The resignation came hours after the Supreme Court ordered the floor test for the Fadnavis-led BJP government on Wednesday to prove their majority in the house.

The top court also ordered Maharashtra Governor Bhagat Singh Koshiyari to appoint the senior-most legislator as the Pro-tem Speaker who will administer the oath of the MLAs to form the government in the state. After the resignations of Devendra Fadnavis and Ajit Pawar, Governor Bhagat Singh Koshiyari appointed BJP MLA Kalidas Kolambkar as the Pro-tem speaker. Soon after taking the oath as Pro-tem Speaker, Kolambkar said that the oath-taking ceremony will start from 8 am tomorrow.

The Supreme Court on Monday reserved its order on a joint petition filed by Shiv Sena, NCP and Congress against Governor Bhagat Singh Koshiyari's decision to swear in BJP leader Fadnavis as chief minister and NCP's Ajit Pawar as deputy chief minister. A bench comprising Justices N V Ramana, Ashok Bhushan and Sanjiv Khanna said it will pass the order at 10:30 am today.

On Monday, the legislators of Shiv Sena, Nationalist Congress Party (NCP) and Congress gathered at Mumbai’s Grand Hyatt in what turned out to be a show of strength by the ‘Maha Vikas Aghadi’. The Sena-NCP-Congress combine decided to “parade” 162 MLAs in the Mumbai five-star hotel where the legislators held banners of 'we are 162' and pledged loyalty to the leadership of Uddhav Thackeray, Sharad Pawar, and Sonia Gandhi.

The show of strength came hours after the Sena-NCP-Congress combine staked claim to form government in Maharashtra and produced a letter to Governor Bhagat Singh Koshyari showing support of 162 MLAs.

4:03 pm: KC Venugopal, Congress on Devendra Fadnavis and Ajit Pawar resign: This is a victory of constitutional democracy. They thought through horse-trading they can make Govt. This is not only a failure of Devendra Fadnavis but also a slap on faces of their masters sitting in Delhi. Today evening there will be joint press conference of the three(Shiv Sena-Congress-NCP) parties and a meeting. In the meeting leader of joint legislative party will be elected, I think Uddhav ji will be elected

3:54 pm: Devendra Fadnavis | We had decided that we will never indulge in horse-trading, that we will never try to break away any MLA. Those who said that we indulge in horse-trading bought the entire horse stable.

3:52 pm: Devendra Fadnavis will tender his resignation to Governor Bhagat Singh Koshyari by this evening. This comes soon after Ajit Pawar resigned as the Deputy Chief Minister of Maharashtra three days after their dramatic swearing-in ceremony on Saturday.

I am sure they will give a good government but I am afraid, this govt will get buried under its own burden. Sena leaders yesterday took Sonia Gandhi's oath. Such helplessness for power for Sena. Congratulations on that helplessness. Only to remove BJP, they have all come together. The BJP will work as an effective opposition. We will give voice to the people. We were asked to form the government. We refused. Sena made fun of itself by claiming the have figures. None of the parties showed strength. So, the President's Rule was imposed."

3:37 pm: Devendra Fadnavis | In elections clear majority was given to Mahayuti and BJP got maximum 105 seats. We contested with Shiv Sena, but this mandate was for BJP because BJP won 70 percent seats out of all seats we contested.

3:35 pm: As you all are aware, it was the BJP that got the people's mandate. But since we fought lesser seats, we got the number that we have. Should we have contested all the seats, it would have been a different story: Devendra Fadnavis

An immediate floor test, in such a case, might be the most effective mechanism to do so. In the present case, the oath has not been administered to the elected members even though a month has elapsed since the declaration of election results. In such emergent facts and circumstances, to curtail unlawful practices such as horse-trading, to avoid uncertainty and to effectuate smooth running of democracy by ensuring a stable Government, we are of the considered opinion that it is necessary to pass certain interim directions in this case. It is necessary and expedient to conduct the floor test as soon as possible to determine whether the chief minister, who was administered the oath of office, has the support of the majority or not. Since the elected members of the Legislative Assembly are yet to take oath as specified in the III Schedule of the Constitution, and the Speaker is also yet to be elected, we request the Governor of the State of Maharashtra to ensure that a floor test be held on 27.11.2019. As per established norms, the senior most member must be called for assuming the role of protem Speaker, after which there must be an open ballot and the same should be   captured in a video recording so as to ensure transparency.
